By accessing or using the services of EterniHost ("we," "us," "our"), you agree to be bound by these Terms of Service ("Agreement").
If you are entering into this Agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these terms.
EterniHost provides Virtual Private Server (VPS) hosting services. All VPS plans and related services are subject to this Agreement. We reserve the right to modify, suspend, or discontinue any part of the services at any time without prior notice.
You must be at least 18 years old to use our services. If you are between 13 and 18 years of age, you may only use the services with verifiable consent from a parent or legal guardian.
You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
You may only use EterniHost services for lawful purposes and in compliance with all applicable laws. The following activities are strictly prohibited (including but not limited to):
We reserve the right to suspend or terminate your service immediately, without refund, if we determine (at our sole discretion) that you have violated this policy.
6.1 Prices are as displayed on the EterniHost website at the time of purchase or as otherwise agreed in writing.
6.2 All fees are payable in advance and are non-refundable except as explicitly stated in Section 7.
6.3 Recurring services are billed according to the billing cycle you select. Failure to pay may result in suspension or termination of your service.
6.4 You are responsible for all applicable taxes (excluding taxes on our net income).
7.1 New VPS purchases are eligible for a full refund if requested within 72 hours of the initial payment and provided the service has not been used for prohibited activities.
7.2 Refund requests must be submitted via ticket from the client area.
7.3 We reserve the right to deny refunds in cases of abuse, fraud, or repeated refund requests.
7.4 After the initial 72-hour period, all payments are non-refundable.
8.1 Services are provided on an "as-is" and "as-available" basis. While we strive for high availability, we do not guarantee any specific uptime percentage or offer Service Level Agreements (SLAs) unless explicitly agreed in writing.
8.2 You are solely responsible for backing up your data. We are not liable for any data loss. Upon termination or expiration of service, your data will be deleted.
8.3 To the fullest extent permitted by law, EterniHost shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data. Our total liability in any matter arising from or related to this Agreement is limited to the amount you paid us in the one (1) month preceding the event giving rise to the claim.
We may terminate or suspend your account at any time, with or without cause and with or without notice. Upon termination, your right to use the services ceases immediately, and all data will be permanently deleted.
This Agreement shall be governed by and construed in accordance with applicable laws. Any disputes arising from this Agreement will be subject to binding arbitration or the jurisdiction of competent courts.
We may modify these Terms at any time. We will notify you of material changes via email or by posting a notice in the client area. Continued use of the services after changes constitutes acceptance of the updated terms.
